Who will save Ex-Warri Prime Minister, Chief Ayiri Emami?

Warri High Chief Ayiri Emami is not in the best of mood lately most especially after coming under fire posing a strong opposition to the selection and coronation of the Olu of Warri Ogiame Atuwase III Olu Emiko Tshola. Ayiri averred that; the selection of the then Omoba designate now Olu of Warri ran fowl of the selection process.

 

After several controversies which led to his suspension by the Ginuwa 1 Ruling house as the Ologbotsere traditional Prime Minister of Warri Kingdom, some claimed that according to Warri customary and chieftaincy law, the Ginuwa 1 ruling house has the constitutional power to suspend any chief. Ayiri is currently in court to challenge his suspension as the traditional prime minister, selection and coronation of the new Olu of Warri.

After several backs and forth, against all odds, the Olu of Warri was coronated amidst pomp and pageantry on the 21st of August at the Ode Itshekiri. The coronation of the new Olu has further buried all impending issues as regards coronation as the Olu has since moved on with the business of leading and repositioning the kingdom. On the 1st of September via a memo with the seal of the Olu states that; “I, Ogiame Atuwatse III, hereby, announce, for the information of the general public, the Delta State government and particularly, the traditional rulers and chiefs committees, the dissolution of all traditional councils, committees, sub-committees and the scheduled exercise of revalidation/confirmation effective from the 2nd day of September, 2021. For the avoidance of doubt, the Warri Council of Chiefs, the Olu Advisory Council (Ojoye Ojisan), the Olu-in-Council, all standing ad hoc and sub-committees are dissolved forthwith; the mandatory revalidation/confirmation of Chieftaincy titles shall commence on the 2nd day of September 2021.”

 

Sources further claimed that; after the memo by the Olu on revalidation of all titleholders in the kingdom, Chief Ayiri was not recognized by the Olu of Warri as the Ologbotsere. He was said to have been stripped of the highly coveted title after his antagonism for the newly installed Olu. Days ago, the former Warri prime minister took edibles as he went to appease the gods of the water (Olokun) to save him from the imminent shame that is currently befalling him. “The revalidation exercise is to make sure titles are given to worthy people who are loyal to the new Olu of Warri. It’s just like a governor or President dissolving cabinet members from a previous government. As it stands, Chief Ayiri has lost the title as the Ologbotsere. A new occupant of that title would not be announced anytime soon as there would be no Ologbotsere during the reign of Ogiame Atuwase III. It’s in line with the traditional consitiution power of the Olu to give a title and also revoke it. The only reason Ayiri can be given back that title is if he buries his ego and apologize to the Olu and withdraw all lawsuit in court challenging his validity and candidacy then, he might be given a second chance if not his removal remains valid” A source said.

 

Another close source averred that Ayiri is currently in talks with some high-profile individuals in the kingdom and the country to help him persuade the Olu to rescind his decision of stripping him of the title. The pleas have not been accepted. As we speak he is running from pillar to post to salvage the situation. a source added.

Other notable personalities include Minister for Women Affairs, Dame Pauline Tallen,  Dere Awosika, Abike Dabiri, Bisi Onasanya. Wives of Governors of Lagos, Ogun, Jigawa, Kwara, Ekiti States will also join other First Ladies to Walk in clusters in their respective States.

Ex-Model Helen Prest Has No Shares in First Foundation – Mrs Oluwayemisi Ajayi

As the legal battle rages on between former Ms. Nigeria, Helen Prest, and Mrs. Oluwayemisi Ajayi, the wife of the deceased medical doctor and businessman, Dr. Ademola Oluwatosin Ajayi, a new twist has been added to the case as Mrs. Oluwayemisi Ajayi has filed an application before the Federal High Court in Lagos, urging the court to set aside the order obtained by Ms. Helen Prest and her daughter, Tomisin Ajayi, granting them leave to institute the pending action and restraining Mrs. Oluwayemisi Ajayi from running First Foundation Medical Engineering Company Limited, the company in which she and her husband are shareholders.

She contended that the order is a nullity on the ground of fundamental irregularity, lack of jurisdiction and denial of fair hearing.

The presiding Judge, Justice Tijjani Ringim, gave the ruling in an application filed by Miss Tomisin Ajayi and Mrs. Helen Prest Ajayi as 1st and 2nd Applicants respectively, through their counsel, Mr. Abiodun Jellili Owonikoko, (SAN).

The 1st to 4th Respondents/Applicants in the suit are First Foundation Medical Engineering Company Ltd, Registrar-General of the Corporate Affairs Commission (CAC); Mrs. Oluwayemisi Ajayi and a lawyer, Mr. Patrick Abak and the 1st, 3rd and 4th Respondents are being represented by Mr. Kunle Adegoke SAN.

First Foundation Medical Engineering Company Limited was owned by the late Dr. Tosin Ajayi in equal shares with her wife, Mrs. Oluwayemisi Ajayi.

However, the Respondents have also filed a counter-affidavit to the originating motion stating their reactions in addition to an application to set aside the order of court granted on 5th August 2021. In an affidavit sworn to by a legal practitioner Afeez Ishola Soliu of Kunle Adegoke & Co., the deponent averred that on the 9th day of September 2021, upon conducting a search of the Court’s file in respect of this suit, to their greatest dismay, they discovered that the matter had come upon two occasions, without service of hearing notice of the proceedings on the respondents, but that ruling had also been delivered in respect of the originating summons by which the Plaintiffs sought orders to restrain the Respondents.

Due to the apparent deliberate suppression of facts and glaring act of bad faith on the part of the Plaintiffs, the court was misled to entertain the proceeding of 2nd of September, 2021 under the belief that the respondents had notice of the said proceedings. No form of hearing notice whatsoever, whether emanating from the court or from the applicants, was served on their counsel or even on the respondents.

The Respondents contended that failure to serve hearing notice is a breach of the fundamental principle of fair hearing and that as at the 7th day of September 2021 when the originating summons dated 23rd July, 2021was heard and determined, the respondents were still within time to respond to the allegations of the Plaintiffs but were denied the right to respond to the said originating summons.

By virtue of the foregoing, the proceeding of the court conducted without the issuance of hearing notice to the respondents are liable to be set aside, the Respondents contended. Consequently, the three respondents comprising; First Foundation Medical Engineering Company Limited, Mrs. Oluwayemisi Ajayi and Mr Patrick Abak are urging the court to set aside the entire proceedings of the court conducted on the 2nd and 7th days of September 2021 for being a nullity on grounds of fundamental irregularity, lack of jurisdiction and denial of fair hearing. They also sought an order compelling the plaintiffs, Mrs. Hellen Prest Ajayi and her daughter Miss Tomisin Ajayi to effect payment, to the three respondents in respect of the undertaking made pursuant to which the plaintiff’s interlocutory prayers were granted by the court, the said order being liable to be set aside.

In a counter-affidavit sworn to by Mrs. Oluwayemisi Ajayi against the originating motion which is the substantive suit, Mrs. Ajayi stated that she was aware that Miss Tomisin presents herself as the love child of an adulterous relationship between her deceased husband, Dr. Tosin Ajayi and his adulteress, Mrs. Helen Prest. According to Mrs. Ajayi, although she is not in a position to confirm if Tomisin Ajayi is a child of her deceased husband as her deceased husband never introduced her or to any other member of the family, since her husband’s passing, she and her children have, in good faith, decided not to dispute the paternity of Tomisin but decided to accept her as one of the beneficiaries of the estate of her deceased husband together with her children.

Mrs. Ajayi averred further that, at the time of the incorporation, the name of the company was First Foundation Medical Company Limited on 6th June,1980 before it was changed to First Medical Engineering Company Limited in April, 2002. And that since the incorporation of the company, she has always been a shareholder and Director of the company and holds 50% of the shares of the company. She said that at no time did her deceased husband and her terminate their marriage as their marriage was always extant and never dissolved till he died.

She admitted that Helen was her deceased husband’s concubine but never a shareholder of their company First Foundation Medical Engineering Company Limited, but a mere meddlesome interloper with no legally cognizable relationship with the company, therefore she had no reason whatsoever to act prejudicially or oppressively to the plaintiffs who as a matter of fact are strangers to the company. She contended further that the Plaintiffs have no right to institute the action as they are not shareholders of the company. To demonstrate her good faith, she deposed in her affidavit that she caused her lawyers to write to Tomisin Ajayi to join in her children’s application to obtain Letters of Administration for their deceased father but Tomisin replied through her lawyer that she did not want to have anything to do with her and her children.

She contended that the plaintiffs are on a mission rooted in corporate robbery sought to be carried out in the garment of the law and that the instant suit, together with the application for an injunction, is frivolous, vexatious and without any basis. Consequently, in the interest of justice, she contended that the reliefs sought by Helen Prest in the originating motion for 50% of her husband’s estate, should be refused.

The matter has not been given a new date.

Evelyn Joshua widow of the deceased ‘Man of God’; founder of the Synagogue Church of all Nation (SCOAN), Temitope Balogun Joshua connotes the mien and character of a woman whose strength is drawn from Athena; the Greek goddess of wisdom, strength and courage. All her life, she has dedicated it to the works of her creator thereby serving as moral support and a shoulder to lean on for her late husband who is a widely known televangelist across the world.

In respecting the decision of her husband; she operated behind the scene. Her giant strides in the growth of the ministry were felt across board like a typical home builder. When many thought the shocking demise of her husband will take its toll on her; she remained strong and resilient. Those who paid her on condolence visit averred that; her demeanor and composure needed to be commended as she showed the braveness of a lioness.

After the burial of her husband; several controversies erupted; most especially on the leadership structure on who takes over from where the late prophet TB Joshua stopped. Sources averred that; on the leadership issues, Evelyn remained silent and obey the will of God on who leads the church to the next level. Some impatient individuals are fuelling media campaigns to bring down her persona by sponsoring a campaign of calumny against her thereby pitching her against church members. “Mama Evelyn is not even in a race with anybody on who leads the church. As the leader of the Church, all she wants is stability. She is interested in is due process as all stakeholders; partners and members are duly carried along on the succession plan. As the wife of the founder, you cannot sweep her influence on the church under the carpet. All she has been doing is in the best interest of the growth of the church. She is not in competition or show of power with anyone. But you don’t expect her to keep quiet when things are not going the right way. Her husband will be angry if she allows people to slow down what he has worked assiduously for years after his demise.”

“Every issue is under control as there is no cause for alarm. People are just blowing the issue out of proportion. The sensationalism on the issue is quite enormous. Some people are just sitting and creating imaginary issues; painting a picture that does not even exist. The leadership tussle will soon be a thing of the past. God will play a huge role in who heads the church. Anyone who wants to silent Evelyn Joshua is probably just afraid of her growing influence and the love she has enjoyed from all sundry and how she has displayed maturity and boldness to tackle issues that are surfacing. She is unperturbed and she would never be intimidated. All she is after is things are done in line with the voice of God.” Another source added.
