N32 billion debt: Court orders AMCON to take over properties of Hometrust Savings &Loans boss

   A Federal high court sitting in Lagos south west Nigeria has granted an order  of possession of seven choice properties scattered across Lagos island in Lagos state belonging to a Lagos businessman Samuel Olufunmilayo Ademosun and his wife Toluleke Ademosun to Asset Corporation of  Nigeria AMCON 

 pending the hearing and determination of the debt recovery suit filed against them by AMCON

     The properties were alleged to have been used as securities for credit facilities granted by some banks to two companies  Hometrust Saving &Loans limited and Magna Building Society Limited.

      The presiding Judge, Justice Ayotunde Faji, also ordered that nine bank accounts belonging to Samuel Olufunmilayo Ademosun domicile in two different banks, and four bank accounts of Hometrust Sayings &Loans Limited should also be frozen pending the hearing and determination of the debt recovery suit to be filed by AMCON.

     The court also directed the central Securities  Clearing System Limited to place lien in favour of AMCON over the shares belonging to Hometrust Savings &Loans Limited, Samuel Olufunmilayo Ademosun and Toluleke Ademosun in seven commercial banks and Investment & Allied Insurance company Limited. used as security for the credit facilities granted to Hometrust Savings &Loans limited company.

       The court also directed the officers and men of the Nigeria Police Force or the Nigeria Security and Civil defence Corps  to assist and provide protection to the bailiff of the court and AMCON for the execution of the order taking over possession of the property granted.

         The court made the order based on affidavit sworn to by Okwudili Ikegwuonu, Resolution Officer of AMCON accompanied by written address filed and argued before the court by Barrister Collins Ogbonna 

      In a bid to  recover a debt of N32, 031,255,380.44. Owed four commercial banks, Asset management  corporation of Nigeria AMCON has dragged a Lagos businessman Samuel Olufunmilayo Adenmosun ,his wife Toluleke Adenmosun and seven other limited liability companies before  a Federal high court in Lagos South West Nigeria.

       The seven limited liability companies joined as co-defendants are Hometrust Saving &loan Limited, Investment and Allied Assurance company Limited, Abinvest ventures limited, Magna Building Society Limited, Thomashembrige Insbrokers Ltd, FB Consulting &Global services limited,and HT Real Estate company limited.

   In an affidavit in support of an application for debt recovery suit sworn to by AMCON resolution officer Mr Okwudili Ikegwuonu and filed before the court by a Lagos lawyer Barrister Collins Ogbonna the deponent averred that
Samuel Olufunmilayo Adenmosun is the managing Director of the aforelisted companies while his wife Toluleke Adenmosun is a Director in Hometrust savings & loans limited, who provided part of the properties used as security for the credit facilities granted to Home trust Savings & loans limited. The couple were alleged to have used the accounts of Thomashembridge Insbrokers Ltd, FB consulting &Global services limited and HT Real Estate company limited companies to divert the proceeds of the loan granted to them by the bank

        Between July 26,2007 and 14th of January, 2008,Home trust Savings & Loans limited company requested for and was granted overdraft facilities totaling N13Billion by Keystone bank formerly Bank PHB Plc. The loan was secured by executed deed of all assets debenture of the company, while Olufunmilayo Adenmosun signed the accepted letter, Adenmosun also executed two personal guarantees

       Mr Ikegwuonu alleged  further that, in the course of business the company requested for concession for IMMEDIATE VALUE ON CONFIRMED  cheque and ONE -DAY VALUE for cheques,and in order to assist the company’s business the bank granted the request, the said concession was backed by N1.2Billion and the limit of return cheques was pegged at N1Billion .

     The company also made an application for a NEXT-DAY VALUE line of N10Billion and was granted by the bank, this enable the company to obtain up to 75% immediate value for draft /Cheques issued from any blue -Chip companies before they passed through the normal clearing procedure was cleared by the paying bank.

    The facilities were granted to the company by the bank based on trust, but the company devised a way to unjustly profit from same at the expense of the bank, as it was discovered that the company and Olufunmilayo Adenmosun  got third parties to pay invalid and or unfunded cheques into the company’s accounts knowing that same will be dishonoured by the bank on the next day  before same pass through clearing, pursuant to NEXT DAY facility.

       Home trust savings &loans limited and Olufunmilayo Adenmosun were  kept circumventing and breaching the trust upon which the Next day value facility was based until the bank discovered that most cheque which it had honoured were returned unpaid after going through the normal clearing procedure.     The racket of the company and its alter -ego Olufunmilayo Adenmosun ran as described above is known in banking parlance as CHEQUE -KITTING.

      The company, Samuel  Olufunmilayo  Adenmosun through this cheque kitting draw up to 75% of the value of the Next -day value facility which has a limit of  N10Billion as at the time the bank withdraw the next day value facility they had racked up an outstanding N16.3Billion  debt through their cheque-kitting scheme.

     By letter date 21st Septenber,2008 they admitted their indebtedness to the bank in the sum of N16 137,601,273.37.

     In its indebtedness defunct Oceanic lnternational bank taken over by Ecobank Plc between July 28,2006 and August 5,2008 applied for various sums of loan totalling N4,2billion

      The credit facilities  were secured by personal guarantee of Olufunmilayo Adenmosun and the Deputy Managing Director of the company Tony Ubogu and the corporate guarantee of Allied insurance Co limited

    The indebtedness of the company and its alter ego which has remained unpaid as at 31st January, 2019 stood at N31,228,915.40.

     Magna  Building Society  Limited company,based on its  banker customer relationship obtained a loan of N35million from Broad bank now Union bank, and as part of security for the loan Home Trust Savings & loans limited issued it’s General Indemnity to Union bank.

   Magna Building society utilised the loan and refused to pay its indebtedness.

        Home Trust Savings & loan limited  also obtained N2.2Billion loan from Afribank Plc now Polaris bank, the facility was secured by personal guarantee of Samuel Olufunmilayo Adenmosun and lien on the shares own by the  company   but after the expiration of the facilities the company neglected to repay its indebtedness to the bank.

       Home Trust saving & loan limited obtained loan of N2,850,000,000 from Access bank, the loan was partly secured with the personal guarantee of Olufunmilayo Adenmosun.

       It was alleged that because the facilities aforementioned especially the one of Access bank  were granted to Home trust Savings & loans limited by Access bank base on trust allowed the company got value for cheque fast, drawing against uncleared effect facility the company devised a way to unjustly profit same at the expense of the bank

     AMCON further averred that it was discovered that the company and its Managing Director got third parties paid cheques into the company’s accounts knowing same will be honoured by the  bank.

The company and its managing Director once again practised cheque -kitting scheme earlier described.

         Following from the above the total of the debt owed the AMCON by Home trust Savings &loans limited, Samuel Olufunmilayo Adenmosun as at 31st January,2019 are as follows :

 Ecobank-N29,121,017.752,21

Union Bank plc-N91,065,219.52

Polaris bank plc-N1,673,903,046,.90

Access bank Plc -N1,014,040,445.81

Total-N32,031,255,380.44

        AMCON averred that its counsel had written demand Letters to them but they have failed and neglected to repay the loans, as they have no intention of repaying the loans.

         The hearing of the case suppose to commence today but the court did not sit consequently another hearing date  have to be  fixed.

Elated Polaris Bank Customer commends Bank for excellent customer service

Polaris Bank customer, Ife Michael, who recently aired her concerns on X (formerly Twitter) on a school fees transaction, has commended the Bank for resolving her Complaint swiftly as promised.

 

Ife Michael tweeting via her X handle @V_Ifemichael had called out the Bank for ‘seizing’ her funds as sent from a UK University where she had sought admission.

Polaris Bank reacted promptly to her Complaint and engaged her to explain the process and promised to resolve the issue which the Bank did swiftly.

An apparently elated Ife Michael went back to the micro blogging site to recount her experience with an update on her earlier thread of how the Bank swiftly resolved her Complainant.

The Bank, according to her update “responded and reached out to explain in details the guidelines underpinning FX transaction as it relates in particular to International payment.

In her tweet, Ife Michael expressed gratitude to Polaris Bank’s swift action and transparent communication. According to her, the Bank clarified that the situation was complex but assured her that the funds would be promptly refunded to the school. And Polaris Bank did exactly as it promised as it promptly refunded the money to Roehampton University and initiated necessary processes to streamline the refund.

The engagement began when Polaris Bank’s headquarters made the first contact at 11:48 am, and by 3:41 pm on the same day, Ife Michael confirmed that the Bank had successfully refunded the funds and

fulfilled all required procedures. The Bank also took the extra step of writing to the school to facilitate the process.

This positive outcome highlights Polaris Bank’s commitment to customer satisfaction, responsive and excellent customer service, and adherence to regulatory policies. The incident not only showcases effective conflict resolution but also underscores the power of a Bank fostering transparent communication between it and her customers.

Cristiano Ronaldo wants to leave Manchester United

Cristiano Ronaldo and his agent Jorge Mendes held meetings with United at Carrington on Tuesday, but his position remains unchanged and he wants to play for a club in the Champions League and win major trophies. United do not want him to go, however, and Ronaldo has started training with the team having missed the club’s pre-season tour of Thailand and Australia due to family reasons.

His potential options elsewhere are limited. Chelsea are not an option anymore, while Bayern Munich and Atletico Madrid appeared to publicly rule themselves out this week. “As we’ve seen on Instagram, Ronaldo has been keeping fit, so there are no concerns from Manchester United over his fitness or physical level; he’s one of the fittest players in world football.

“Ultimately, The Portuguese forward did state his desire to leave Old Trafford, but he’s running out of options, and it seems like he’s actually going to have to stay. Perhaps he will try and swing it where the 25 per cent pay cut in his contract will be waived away by United, perhaps he wants to manoeuvre and muscle a new deal, we’ll have to wait and see. But it doesn’t look like Stamford Bridge is on his cards.

“Chelsea have distanced themselves from a deal for Ronaldo, as have Bayern Munich, Napoli and a lot of other elite clubs that Jorge Mendes, who is Ronaldo’s agent, has tried to sell him to. “An offer from Saudi Arabia is astronomical but ultimately, it does not give Cristiano Ronaldo what he wants, which is that legacy. He wants to achieve Champions League records that he thinks no one else will be able to attain in the future.

“He wants to sign off at the absolute highest level. Now, it looks increasingly like he will have to stay at Manchester United because there are no biters from the big clubs.

“Everyone has their forwards already, and Chelsea, who are the only club looking like they could actually potentially be spun by what Cristiano Ronaldo offers off the pitch because we were told that Mendes, while being in front of these clubs, was putting forward his numbers in terms of social media influence, sponsorship that he rakes in, the commercial gain of his shirt sales and stuff like that. But even they now say he is not in their plans. Their immediate aim is to strengthen the defence.

“So, that leaves Ronaldo really with not many choices. We know that he does want to be competing at the highest level so if he does go to Saudi Arabia that cuts against everything he has said and everything we actually know about him and his career.

“Manchester United have always been very calm and very comfortable. They have insisted he is not for sale, and he will see out the last year of his contract. How they manoeuvre this now going forward we’ll see, but Ronaldo is keeping fit, so they have no issues or problems or fears over what state he’ll report back to pre-season in.”

The student was presented with their certificates at the special convocation ceremony held at the International Headquarters of Grace Nation(GBI) in Ojodu Berger Lagos Nigeria. According to the Rector of the institute, they satisfy all requirements and conditions to be awarded a diploma certificate in various fields of Prophetic and Bibles knowledge.

The highlight of the convocation was the Presentation of Certificates to all the students, according to the Rector all the students perform excellently well

Earlier in his sermon, the Senior Pastor Grace Nation and the Generational prophet of God Dr. Chris Okafor teach on the series, ”The Covenant Day of Settlement” said settlement comes when you fulfill all the Principles of Settlement,
the man of God said nothing come free but when you applied the principles and follow it diligently you will easily get a settlement on all side

The realm of the Prophetic witnessed another higher dimension of Prophetic movement and deliverance through the Set Man, the Generational Prophet of God Dr. Chris Okafor, He visited many family altars and set many captives free, he also delivered people with blood-line diseases while delivering miracle babies to expectant mothers

The service came to a close with a special Prayer for the Set Man, the Generational Prophet of God Dr. Chris Okafor who will be making another birthday tomorrow, 4 April 2022.
